Terms of Service

These terms form an agreement between you and Khula. By activating a Khula card, creating an account, or paying someone through the network, you accept them.

Last updated 29 August 2026

1. The service

Khula provides physical NFC cards and QR codes that let an individual or a business receive digital payments. Khula is a technology provider; the movement and settlement of funds is performed by regulated payment partners.

Khula is not a bank and does not hold deposits.

2. Eligibility and accounts

You must be at least 18 years old and resident in South Africa to receive payments through Khula. You must provide accurate information and keep it up to date.

Access to a recipient account is secured with a one-time code sent to your mobile number. You are responsible for the security of the phone that receives that code.

3. Cards and devices

A Khula card remains linked to the person or business that activated it. If a card is lost or stolen, report it immediately so it can be stopped. Stopping a card does not affect money already settled or in transit.

Cards may not be transferred, resold or re-encoded without our written consent.

4. Fees

Fees are shown before a payment is confirmed and are snapshotted against every transaction. Standard pricing is a percentage of the amount plus a fixed component; the exact figures applicable to your account are visible in your dashboard.

We may change fees on reasonable notice. Continued use after a change takes effect constitutes acceptance.

5. Settlement

Successful payments are settled to the bank account you nominate, after fees and once any verification requirements are satisfied. Settlement timing depends on our payment partners and banking cut-off times.

We may delay or withhold settlement where a transaction is suspected to be fraudulent, disputed, or in breach of these terms.

6. Prohibited use

You may not use Khula for illegal activity, money laundering, terrorist financing, the sale of prohibited goods, or to collect payments on behalf of an undisclosed third party. See our Acceptable Use Policy for detail.

7. Suspension and termination

We may suspend or close an account, or stop a card, where we reasonably suspect a breach of these terms, fraud, or a legal obligation to do so. You may close your account at any time; amounts properly owing to you will still be settled.

8. Liability

Khula provides the service with reasonable skill and care but does not guarantee uninterrupted availability. To the extent permitted by law, our liability for any claim is limited to the fees you paid us in the three months preceding the claim.

9. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
